Terms of Service

Please read these Terms of Service ("Terms") carefully before using the classifaily API and platform. classifaily is a product owned and operated by FISION ANALYTICS, LLC, a limited liability company based at 352 Avenue of Oaks, Moncks Corner, SC 29461 ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing the API, or using any part of classifaily, you confirm that you are at least 16 years old, have the legal authority to enter into these Terms, and agree to be bound by them. If you are using classifaily on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. The Service

classifaily provides a REST API and web dashboard that enables text, image, audio, and video classification using AI models ("Service"). We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account. Notify us immediately at security@classifaily.com if you suspect unauthorized access. We are not liable for losses arising from unauthorized use of your credentials.

You may not share API keys across multiple end-users or applications without written permission. Each account may hold multiple API keys for organizational purposes, but bulk reselling of API access is prohibited.

4. Acceptable Use

You agree not to use classifaily to:

• Generate, classify, or facilitate content that is illegal, harmful, threatening, harassing, defamatory, or otherwise objectionable
• Process personal data of third parties without appropriate consent or lawful basis
• Circumvent, reverse-engineer, or attempt to extract the underlying AI models
• Interfere with or disrupt the Service, its infrastructure, or other users
• Exceed your plan's rate limits through automated retry mechanisms designed to bypass throttling
• Resell or sublicense API access without prior written agreement
• Use the Service to build a product that is directly competitive with classifaily using our infrastructure

We may suspend or terminate accounts that violate these policies without notice or refund.

5. Billing & Plans

Paid plans are billed monthly or annually in advance. Prices are displayed on our pricing page and may change with 30 days' notice. All fees are in USD and exclusive of applicable taxes, which you are responsible for paying.

Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until you cancel. Failed payments may result in service suspension after a reasonable grace period. Charges will appear on your bank or card statement as FISION ANALYTICS.

Free plan: Subject to rate limits as defined on the pricing page. We may modify free tier limits at any time.

Starter / Growth plans: Limits are as described on the pricing page at time of subscription. Overages are not automatically billed; requests beyond your limit will return a rate-limit error until the next billing cycle.

6. Cancellation & Refunds

You may cancel your subscription at any time from the Account section of your dashboard. Cancellation takes effect at the end of your current billing period - you retain full access until then. We do not provide prorated refunds for partial billing periods, except where required by law.

Annual plan refund requests within 14 days of initial purchase or renewal will be considered on a case-by-case basis. Contact billing@classifaily.com.

7. Intellectual Property

classifaily and all associated intellectual property - including the API, dashboard, documentation, logos, and underlying technology - are owned by or licensed to us and protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in our Service.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the API in accordance with these Terms and our documentation.

8. Your Content

You retain ownership of all content you submit to classifaily for classification. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

You represent and warrant that you have all necessary rights to submit your content to the Service, and that doing so does not violate any third party's rights or applicable law.

We do not use your content to train AI models or share it with third parties except as necessary to fulfill a classification request (e.g., forwarding to an AI inference provider).

9. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that classification results will be accurate.

AI classification results may contain errors. You are solely responsible for validating outputs before using them to make decisions, especially in high-stakes contexts.

10. Limitation of Liability

To the maximum extent permitted by law, classifaily shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless classifaily and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account and access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will survive, including Sections 7, 9, 10, 11, and 13.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email and/or a prominent notice on the dashboard at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
